OAKHURST - FUEL YOUR ADVENTURES CHOCOLATE MILK SWEEPSTAKES ("SWEEPSTAKES") OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

1. ELIGIBILITY: The Sweepstakes is open to legal U.S. residents of Maine and New Hampshire who are eighteen (18) years of age or older at the time of entry. Void where prohibited. The following persons are not eligible to participate: employees, contractors, directors and officers of Oakhurst Dairy (“Sponsor”), Ethos Marketing & Design (“Administrator”), each of their respective parent, subsidiary and affiliated companies, distributors, Web design, advertising, fulfillment, judging and promotion agencies (“Promotion Parties”), and the immediate family members (spouse, parent, child, sibling, grandparent, and/or “step”) of each and those living in their same households. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Sponsor reserves the right, at any time, to verify eligibility requirements in any manner it deems appropriate. By participating, entrants agree to these Official Rules, which are final and binding in all respects.

2. SWEEPSTAKES TIMING: The Sweepstakes consists of four separate entry periods (each an “Entry Period”) as outlined in the table below. Each Entry Period corresponds to Sponsor’s Sweepstakes posts made on its Facebook and Instagram pages as further described in Section 3. The time clock of the computer administering this Sweepstakes is the official timekeeping device for this Sweepstakes.

3. HOW TO ENTER: During each Entry Period, there are two (2) ways to enter as outlined below. An entrant may enter twice during each Entry Period, once on Facebook and once on Instagram. See entry limit below. Entrants must have a Facebook account to enter via Facebook and an Instagram account to enter via Instagram. Creating a Facebook and/or Instagram account is free. Visit Facebook.com and/or Instagram.com and follow the appropriate links to download either one or both applications to create your account(s).
4. Enter via Facebook: For each Entry Period, look for Sponsor’s post containing the hashtags #FuelYourAdventuresSweepstakes on https://www.facebook.com/OakhurstDairy (@OakhurstDairy) requesting entrants to make a relevant comment on the post (“Sweepstakes Post”). Provide a relevant comment on the Sweepstakes Post (“Entry”) to receive one (1) entry into the random drawing corresponding to the Entry Period in which your comment was submitted.
5. Enter via Instagram: For each Entry Period, look for Sponsor’s post containing the hashtags #FuelYourAdventuresSweepstakes on https://www.instagram.com/oakhurstdairy/?hl=en (@OakhurstDairy) requesting entrants to make a relevant comment on the post (also a “Sweepstakes Post”). Like the post and provide a relevant comment on the Sweepstakes Post (“Entry”) to receive one (1) entry into the random drawing corresponding to the Entry Period in which your comment was submitted.

 

You are also encouraged to tag your “adventure buddy” in your Facebook and Instagram comments and to follow the above Instagram and Facebook pages.  However, tagging and linking are not required to enter.  Entrants must have a public profile on the Facebook account and/or Instagram account used to enter in order to be contacted by Sponsor if he or she is selected as the potential winner.

Comments made on a Sweepstakes Post after its corresponding Entry Period’s End Date/Time will NOT be included in any Entry Period Drawing (defined in Section 4). Comments made on your personal Facebook or Instagram page are not eligible for the Sweepstakes. Proof of submission of an Entry does not constitute proof of delivery of an Entry.

Limit one (1) entry per person per Facebook account per Sweepstakes Post per Entry Period. Pl Limit one (1) entry per person per Instagram account per Sweepstakes Post per Entry Period. 

Entries will not be judged. Any Entry or portion thereof that is, in the Sponsor’s sole discretion, inconsistent with Sponsor’s desired image, offensive, obscene, profane, lewd, defamatory, contains any proper names, third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand (other than Sponsor’s) or other proprietary right of any entity or person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light), or is otherwise objectionable, will not be accepted as an Entry and may disqualify entrant from further participation in the Sweepstakes in the sole discretion of Sponsor.

Entries must comply with these Official Rules and the Facebook and/or Instagram Terms of Use and Privacy Notice, depending on participation method(s). In the event of a conflict between the Sweepstakes Official Rules and Facebook or Instagram Terms of Use and Privacy Notice, the Sweepstakes Official Rules shall govern.

Multiple entrants may not share the same social media account. A potential winner may be requested to provide Sponsor with proof that he or she is the authorized account holder of the social media account associated with the winning Entry and/or an eligible entrant. Use of multiple social media accounts (more than one per platform) for the purpose of obtaining more than the stated number of entries allowed per Entry Period is prohibited and such persons will be disqualified and all their Entries shall be deemed invalid.

Data rates may apply if entering with a mobile phone or other Web-enabled device using your wireless service provider’s network. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges.

5. RANDOM DRAWINGS/ODDS: For Entry Periods 1, 3 and 4, two (2) potential winners will be selected iand for Entry Period 2, three (3) potential winners will be selected, each in a random drawing to be held on or about the Drawing Date as stated in Section 2 from among all eligible Entries received for that Entry Period (“Entry Period Drawing”). Entries will not carry forward to subsequent Entry Period Drawings. Odds of winning a prize depend on the number of eligible Entries received for a given drawing. All Entry Period Drawings will be conducted by the Administrator, whose decisions are final. Limit one (1) prize per person/household for the Sweepstakes.
6. WINNER NOTIFICATION: Potential winners will be notified via direct message (“DM”) through the social media account used for entry and associated with the selected Entry. Potential winners will be required to respond to the notification (as stated within the notification) within ten (10) days. If a potential winner (i) is disqualified, found to be ineligible or not in compliance with these Official Rules; (ii) declines to accept the prize; or (iii) does not reply to notification as stated above, the prize may be forfeited and an alternate winner selected from among all remaining eligible Entries (for the applicable Entry Period Drawing), as determined by Sponsor in its sole discretion. Sponsor and Promotion Parties are not responsible for suspended or discontinued wireless or online service which may result in a potential winner not receiving a notification. Sponsor is not responsible for any change in entrant’s contact information, including their social media or email accounts. If, after a good-faith attempt, Sponsor is unable to award or deliver a prize, such prize may not be awarded. Sponsor and Promotion Parties are not responsible for any undelivered emails or unanswered DM’s, including without limitation, emails or DM’s that are not received because of a winner’s privacy or spam filter settings which may divert any Sweepstakes email, including any winner notification email, to a spam or junk folder. Prizes will be shipped within six (6) to eight (8) weeks of winner verification. Upon forfeiture for any reason as stated within these Official Rules, no compensation will be given.

Total ARV of all prizes is $2,000.00. Any difference between stated value and actual value will not be awarded. Each winner will be responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prize he or she receives, regardless of whether it, in whole or in part, is used. No cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsor. No transfer of prize is permitted. Unclaimed prizes will not be awarded. If the prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value.

7. LIMITATIONS OF LIABILITY AND RELEASE: By participating in the Sweepstakes, entrant agrees to release and hold harmless the Sponsor, Promotion Parties, and any of their respective parents, subsidiaries, affiliates, and each of their respective employees, shareholders, directors, officers, members, successors, agents, and assigns (collectively, the “Released Parties”) from any and all claims, damages or liabilities arising from or relating to such entrant’s participation in the Sweepstakes; any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes; from acceptance, possession, misuse or use of any prize awarded or while preparing for, participating in, and/or traveling to and from any prize-related activity or any typographical or other error in the printing of these Official Rules or the offering or announcement of any prize. The Released Parties are not responsible for (i) lost, late, mutilated, illegible, unintelligible, incomplete, misdirected or postage-due mail or Entries; (ii) entrant’s participation in or attempt to participate in the Sweepstakes or ability or inability to upload or download any information in connection with the Sweepstakes; (iii) hardware or software errors, faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online or network communication problems; (iv) errors or limitations of any Internet or wireless providers, servers, hosts or other providers or a Sweepstakes-related social media platform; (v) garbled, jumbled or faulty data transmissions; (vi) failure of any online transmissions to be sent or received; (vii) lost, late, delayed or intercepted transmissions; (viii) inaccessibility of a social media account used for entry in whole or in part of any reason; (ix) traffic congestion on the Internet; (x) unauthorized human or non-human intervention of the operation of the Sweepstakes, including without limitation, unauthorized tampering, hacking, theft, virus, bugs or worms; (xi) destruction of any aspect of the Sweepstakes; or (xii) loss, miscount, misdirection, in accessibility or unavailability of a social media or email account used in connection with the Sweepstakes. Released Parties are not responsible for any typographical, technical, computer, network or human errors which may occur in the administration of the Sweepstakes, the processing of Entries, the announcement of prizes or in any Sweepstakes-related materials. Use of a social media platform or website associated with the Sweepstakes is at Entrant’s own risk. Released Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user’s or any other person’s computer or web-enabled device resulting from participation in the Sweepstakes. If the Sweepstakes, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible Entries received up to the date of discontinuance for the prize(s) offered herein.
8. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the security, fairness, integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Released Parties are not liable if any portion of the Sweepstakes is canceled due to weather, fire, strike, acts of war or terrorism, epidemic or pandemic, federal, state, or local government order, or any other condition beyond their control (a “Force Majeure Event”).
9. DISPUTES: Except where prohibited, entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Except where prohibited by law, by participating, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Tennessee, without giving effect to any choice of law or conflict of law rules. By entering, entrants, consent to the jurisdiction and venue of the federal and local courts located in the State of Maine.
10. PUBLICITY: Except where prohibited by law, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s and its designees’ use of winner’s name, likeness, photograph, voice, image, statements, biographical information, and/or hometown and state at any time or times for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, including the Internet, without review, notification, or approval, and additional payment or consideration.
11. PRIVACY: Information collected from entrants is subject to Sponsor’s Privacy Policy: https://www.dfamilk.com/privacy-policy. Winners’ names may be included in a winner’s list available to the public.

This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook or Instagram. Any questions, comments or complaints regarding this Sweepstakes shall be directed to the Sponsor and not to Facebook or Instagram. You acknowledge that the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or any other social networking service.  You understand that by entering the promotion you are providing personal information to Sponsor and the various users of such social networks, but specifically not to Facebook or Instagram.  You further agree to indemnify and hold harmless Facebook and Instagram from and against any and all liability resulting or arising from the Sweepstakes and to release all rights to bring any claim, action or proceeding against such social networks.
